1. Agreement to Terms

By using Terra products or services, you agree to be bound by these terms. If you do not agree, do not use our products.

2. Who Can Use Terra

You must be at least 18 years old to use our services.

3. Account and Device Use

• You are responsible for maintaining the confidentiality of your account and password. Terra devices use AI to record short clips (3 seconds) only when detecting potential wildlife activity. We may request personal and billing information (e.g., name, email, payment card details) to process orders. You represent and warrant that your submitted payment information is accurate and lawfully used.

4. Data Ownership and Usage

• All audio and related data are owned by Terra. By using the device, you grant Terra full rights to store, use, and share this data in perpetuity. Data may be shared with scientific or conservation partners such as Motus (Birds Canada). Terra may aggregate and use data to enhance services or for research. You assign any feedback, recordings, or content submitted to Terra for unrestricted use. You may use audio and related collected data on your Terra for any purpose, commercial or non-commercial.

5. Privacy and Location

• Terra displays approximate device locations on a public map and shares location data with researchers. You may reduce your location accuracy in the settings. Your live stream is not recorded. Detection-triggered recordings are separate and permanent. You may opt to locally record audio streams for long periods of time, which does not get sent to Terra servers.

6. Restrictions

• Do not misuse the device or data. Do not attempt to reverse-engineer or repurpose the technology. Comply with local laws concerning outdoor recording devices.

7. Disclaimer

• Terra is not responsible for misuse of devices or noncompliance with local laws. Service is provided "as is" without warranties.

8. Indemnification

You agree to indemnify and hold harmless Terra, its affiliates, employees, and agents from any claims, damages, liabilities, or expenses arising out of your use of the service or violation of these Terms, including any legal fees.

9. Limitation of Liability

To the maximum extent permitted by law, Terra’s total liability shall not exceed the amount you paid for the product. Terra shall not be liable for any indirect, incidental, or consequential damages arising from the use of the product or service.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New Jersey. Any legal action or proceeding relating to your access to or use of the service shall be instituted exclusively in the courts of Cape May County, New Jersey.

11. Changes to Terms

We may update these terms periodically. We’ll notify users of material changes.

12. Consent

By using Terra, you consent to both this EULA and our Privacy Policy.

1. Introduction

Terra respects your privacy. This Privacy Policy describes how we collect, store, use, and share your information when you use our website and devices. By using Terra products or services, you agree to the terms outlined in this Privacy Policy.

2. What We Collect

We may collect:

• Name, email address, phone number, and shipping information


• Audio recordings from Terra devices (see below)


• Device and usage data (IP address, browser, access times, etc.)


• Processor status, device temperature, and system load


• Average audio levels at a perodic interval


• WiFi network information, signal strength, WiFi name, bit rates, etc


• GPS location data (Accuracy customizable by user)


• Billing and payment details (e.g., credit card info) when placing orders

3. Audio Recording and Storage

• Terra devices do not record continuously unless placed into field recording mode. In such a mode, audio recordings are retained locally on the device. We record 3-second audio snippets only when the AI system detects a potential bird or animal sound. These clips are stored indefinitely on Terra’s secure servers. Recorded clips accessable for public review, unless explictly set within your privacy settings When disabled for public review, They are accessible only to you (via your password-protected account) and authorized Terra administrators and research partners. When you stream audio live from your Terra, that stream is never recorded. The live stream and the identification stream are completely separate.

4. Data Usage and Ownership

• Terra owns all audio data and metadata collected. We use it to improve identification, share with research partners, and support conservation efforts. We share data with trusted conservation partners like Motus (Birds Canada), Conservation Science Global and Cellular Tracking Technologies, our parent wildlife company. Location data may be shown publicly on map.terralistens.com, but users can adjust the precision of their displayed GPS coordinates. By submitting any feedback or recordings, you grant Terra the right to use, reproduce, distribute, and display it without restriction.

5. Data Security and Retention

• We use strong encryption and access controls to protect stored audio and user data. Data is retained indefinitely unless required to be removed by law.

6. No Advertising or Third-Party Marketing

• We do not sell, rent, or share your data with advertisers. Your personal and audio data will never be used for marketing, profiling, or targeted advertising.

7. Legal Compliance

• Users are responsible for complying with local laws regarding audio recording. These laws are often similar to those governing video doorbells or security cameras.

8. Children’s Privacy

• We do not knowingly collect personal data from children under the age of 13. If we become aware that we have inadvertently collected such data, we will delete it promptly.

9. Your Rights

You may:

• Access or update your data
• Adjust your location display settings
• Delete your account by contacting support@terra.zohodesk.com or the DELETE ACCOUNT button under account settings.
